1. Acceptance of Terms

Welcome to Green Lantern Pizza ("Company," "we," "us," or "our"). Your continued use of our Site or Services following any modification to these Terms constitutes your acceptance of the revised Terms.

If you are using our Services on behalf of a business, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and references to "you" shall include both you individually and such entity.

You must be at least 13 years of age to use our Site. Minors under the age of 18 may only use our Services with the supervision and consent of a parent or legal guardian.

4. Ordering, Pricing, and Payment Terms

4.1 Order Placement

When you place an order through our website, by phone, or in person, you are making an offer to purchase the selected items at the listed price. All orders are subject to acceptance and availability. We reserve the right to refuse, cancel, or limit any order at our sole discretion, including orders that appear to be placed fraudulently or in violation of these Terms.

Once an order is confirmed, you will receive an order confirmation. This confirmation does not guarantee that all items will be available. In the event that any item is unavailable, we will attempt to contact you using the information provided.

4.2 Pricing

All prices listed on our Site or in our menus are in United States Dollars (USD) and are subject to change without prior notice. Prices shown at checkout reflect the most current pricing. Applicable sales taxes, delivery fees, and service charges will be calculated and displayed at checkout. We are not responsible for pricing errors, and we reserve the right to cancel or adjust orders affected by pricing errors.

4.3 Payment

We accept various forms of payment including major credit and debit cards (Visa, MasterCard, American Express, Discover), digital payment platforms as indicated on our website, and cash for in-store and certain delivery transactions. By providing payment information, you represent and warrant that you are authorized to use the payment method provided and that all payment information is accurate and complete.

4.4 Refunds and Cancellations

Due to the perishable nature of food products, all sales are generally final once an order has been prepared. If you believe there is an error with your order — including receiving the wrong items, missing items, or food quality concerns — please contact us immediately at [email protected] so we may assess the situation and, at our discretion, offer a replacement, store credit, or partial/full refund. Refund determinations are made on a case-by-case basis and are entirely at Green Lantern Pizza's discretion.

5. Intellectual Property Rights

All content, materials, and intellectual property available on or through our website and Services — including but not limited to our company name, logo, trade dress, trademarks, service marks, domain name, website design, graphics, text, photographs, videos, audio clips, software, source code, menu content, and any other proprietary material (collectively, "Intellectual Property") — are the exclusive property of Green Lantern Pizza or our licensors and are protected under applicable United States intellectual property laws, including but not limited to the Copyright Act (17 U.S.C. § 101 et seq.), the Lanham Act (15 U.S.C. § 1051 et seq.), and applicable state intellectual property statutes.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our Site for personal, non-commercial purposes only. This license does not include the right to:

  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of our Intellectual Property without our express written consent.
  • Modify, create derivative works from, or adapt any of our content or materials.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices from our content.
  • Use our trademarks, logos, or brand identity in any manner that implies endorsement or affiliation without our written consent.
  • Frame or mirror our website on any other website without our prior written authorization.

Any unauthorized use of our Intellectual Property may constitute copyright or trademark infringement and is grounds for immediate termination of your access to our Services, as well as potential civil and/or criminal liability under applicable law.

If you believe that any content on our website infringes upon your intellectual property rights, please contact us at [email protected] with a detailed description of the alleged infringement.

6. Disclaimers and "As-Is" Basis

OUR SERVICES, WEBSITE, AND ALL CONTENT CONTAINED THEREIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GREEN LANTERN PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WARRANTIES THAT OUR WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
  • WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT, MENU INFORMATION, NUTRITIONAL DATA, OR OTHER INFORMATION ON OUR SITE.
  • WARRANTIES THAT OUR WEBSITE OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We do not warrant or represent that our food products will meet your specific dietary requirements, restrictions, or preferences unless expressly indicated. You acknowledge that food products may contain allergens including gluten, nuts, dairy, eggs, soy, shellfish, and other common allergens. It is your sole responsibility to inform us of any dietary restrictions or food allergies before placing an order. While we make reasonable efforts to accommodate dietary needs, we cannot guarantee the complete absence of any allergen in any item due to the risk of cross-contamination in our kitchen environment.

Estimated preparation and delivery times are approximations only and are not guaranteed. We shall not be liable for any delays in food preparation or delivery due to circumstances beyond our reasonable control.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE FEDERAL AND STATE LAW, IN NO EVENT SHALL GREEN LANTERN PIZZA, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, OR AFFILIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
  • LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL;
  • PERSONAL INJURY OR PROPERTY DAMAGE NOT RESULTING FROM OUR GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT;
  • DAMAGES ARISING FROM YOUR INABILITY TO ACCESS OR USE OUR SERVICES;
  • DAMAGES ARISING FROM ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR YOUR PERSONAL INFORMATION;
  • DAMAGES ARISING FROM ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE TRANSMITTED THROUGH OUR SITE BY ANY THIRD PARTY;

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE GREATER OF: (A) ONE HUNDRED DOLLARS ($100.00 USD), OR (B) THE TOTAL AMOUNT PAID BY YOU TO GREEN LANTERN PIZZA IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless Green Lantern Pizza, its owners, officers, directors, employees, agents, independent contractors, licensors, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to reasonable attorneys' fees and court costs) arising from or relating to:

  • Your access to or use of our Services or website;
  • Your violation of any provision of these Terms of Service;
  • Your violation of any applicable federal, state, or local law, regulation, or ordinance;
  • Your infringement of any intellectual property, privacy, or other right of any third party;
  • Any content, information, or materials you submit, post, or transmit through our Services;
  • Your fraudulent, abusive, or otherwise wrongful conduct in connection with our Services;
  • Your misrepresentation of any information provided to Green Lantern Pizza.

We reserve the right, at our own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of such claim. You shall not settle any claim without our prior written consent.

9. Privacy and Data Collection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, available on our website. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.

To the extent you are a resident of California, your rights regarding personal information are governed by the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), as further detailed in our Privacy Policy. These rights may include the right to know what personal information we collect, the right to delete personal information, the right to opt out of the sale or sharing of personal information, and the right to non-discrimination for exercising your privacy rights.

For users in other states where specific consumer privacy legislation applies, we endeavor to comply with all applicable state privacy laws and regulations.

10. Third-Party Links and Services

Our website may contain links to third-party websites, applications, or services, including third-party delivery platforms, payment processors, and social media platforms. These third-party services are not owned or controlled by Green Lantern Pizza, and we make no representations or warranties regarding their content, privacy practices, or terms of service.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We strongly encourage you to review the terms and privacy policies of any third-party sites you visit. The inclusion of any link does not imply our endorsement of the linked website or service. If you use a third-party delivery platform to order from us, your use of that platform is subject to that platform's terms and conditions.

11. Food Safety and Allergen Notice

Green Lantern Pizza is committed to maintaining high standards of food safety and quality. All food products are prepared in a commercial kitchen environment that may handle a variety of allergens, including but not limited to: wheat/gluten, tree nuts, peanuts, dairy/milk, eggs, soy, sesame, shellfish, and fish.

While we take reasonable precautions to prevent cross-contact, we cannot guarantee that any menu item is completely free from allergens due to the nature of our kitchen operations and shared cooking equipment. Customers with food allergies, intolerances, or specific dietary requirements are strongly advised to notify us before placing an order and to consult with our staff regarding ingredients and preparation methods.

Green Lantern Pizza shall not be liable for any allergic reactions or adverse health events resulting from consumption of our food products where you have failed to disclose a known allergy or where the allergen information has been clearly communicated.

12. Governing Law and Jurisdiction

These Terms of Service, and any disputes arising from or related to them or your use of our Services, shall be governed by and construed in accordance with the laws of the United States of America and the applicable state laws of the state in which Green Lantern Pizza maintains its principal place of business, without regard to conflict of law principles.

By using our Services, you consent to the exclusive personal jurisdiction and venue of the federal and state courts located within the United States for the resolution of any disputes arising under these Terms that are not subject to arbitration as described below. This choice of law provision does not apply to the extent it would deprive you of rights under mandatory consumer protection laws in your jurisdiction.

Green Lantern Pizza's operations are subject to applicable federal regulations, including but not limited to the FTC Act (15 U.S.C. § 45 et seq.) governing unfair or deceptive acts or practices, the Food Safety Modernization Act (FSMA), and applicable FDA regulations governing food safety and labeling.

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising from or relating to these Terms or our Services informally. To initiate informal dispute resolution, please contact us at [email protected] with a written description of your complaint and the relief you are seeking. We will attempt to resolve the dispute within thirty (30) days of receiving your notice. If the dispute is not resolved within this period, either party may proceed to formal dispute resolution.

13.2 Binding Arbitration

EXCEPT AS PROVIDED BELOW, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THEREOF, OR TO THE USE OF OUR SERVICES, SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES, WHICH ARE INCORPORATED HEREIN BY REFERENCE.

The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding. The arbitrator may award the same damages and relief that a court could award, subject to the limitations described in these Terms. Judgment on the arbitration award may be entered in any court of competent jurisdiction. You agree that any arbitration shall be conducted on an individual basis only and not as a class action, representative action, or consolidated proceeding.

13.3 Exceptions to Arbitration

Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights, or to address imminent irreparable harm. Small claims court actions, where applicable, are also excluded from the arbitration requirement.

13.4 Class Action Waiver

YOU AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY AND ALL DISPUTES SHALL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN THROUGH ARBITRATION, EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL.

14. Term and Termination

These Terms of Service shall remain in full force and effect for as long as you use our website or Services. We reserve the right, in our sole and absolute discretion, to suspend or terminate your access to all or any portion of our Services at any time, with or without notice, for any reason, including but not limited to:

  • Your violation of any provision of these Terms;
  • Conduct that we, in our sole discretion, believe is harmful to other users, our employees, or our business;
  • Fraudulent, abusive, or unlawful activity;
  • Requests from law enforcement or government agencies;
  • Technical, security, or operational reasons.

You may also terminate your use of our Services at any time by discontinuing access to our website and, if applicable, closing your account. Upon termination, all licenses and rights granted to you under these Terms shall immediately cease.

Provisions that by their nature should survive termination shall survive, including but not limited to sections relating to intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law.

15. Changes to These Terms

Green Lantern Pizza reserves the right to modify, update, or revise these Terms of Service at any time at our sole discretion. When we make material changes to these Terms, we will update the "Last Updated" date at the top of this page. We may also, at our discretion, notify you of significant changes by posting a notice on our website or by sending an email to the address associated with your account.

Your continued use of our website or Services following the posting of revised Terms constitutes your acknowledgment of and agreement to the updated Terms. If you do not agree to the revised Terms, you must discontinue your use of our Services immediately. We encourage you to review this page periodically to stay informed about our current Terms.

16. Severability

If any provision of these Terms of Service is found by a court, arbitrator, or other tribunal of competent jurisdiction to be invalid, illegal, unenforceable, or in conflict with any applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect and shall be binding upon the parties.

The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision herein. The parties agree to negotiate in good faith to replace any invalid or unenforceable provision with a valid provision that achieves, to the greatest extent possible, the economic, business, and legal purposes of the original provision.

17. Entire Agreement and Waiver

These Terms of Service, together with our Privacy Policy and any other policies, guidelines, or agreements incorporated herein by reference, constitute the entire agreement between you and Green Lantern Pizza with respect to your use of our website and Services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral, with respect to such subject matter.

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver of a provision of these Terms must be in writing and signed by an authorized representative of Green Lantern Pizza to be effective. No waiver of any breach shall be construed as a waiver of any subsequent breach of the same or any other provision.

18. Force Majeure

Green Lantern Pizza shall not be liable for any failure or delay in performance of our obligations under these Terms where such failure or delay results from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic or epidemic events, fire, flood, earthquake, severe weather, acts of terrorism, war, civil unrest, governmental actions or restrictions, labor disputes or strikes, supply chain disruptions, power outages, internet or telecommunications failures, or any other cause beyond our reasonable control ("Force Majeure Event").

In the event of a Force Majeure Event, we will provide notice to you as soon as reasonably practicable and will resume performance as soon as reasonably possible following the cessation of the Force Majeure Event.

19. Electronic Communications

By using our website or Services, or by communicating with us via email, you consent to receive electronic communications from Green Lantern Pizza. These communications may include order confirmations, promotional emails, policy updates, and other operational messages. You agree that any notices, agreements, disclosures, or other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

If you have signed up to receive promotional communications and wish to unsubscribe, you may do so at any time by following the unsubscribe instructions in the relevant email or by contacting us at [email protected]. Please note that even after unsubscribing from promotional communications, you may continue to receive transactional and operational communications related to your orders or account.
